The rule, under Article 236 of Brazil&#8217;s Electoral Code, remains in effect until 5 PM on October 6 \u2014 48 hours after the end of first-round voting, set for Sunday (4) \u2014 and is meant to guarantee that everyone can vote freely.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What changes starting today<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">During this period, no authority may arrest or detain any voter, except in cases provided for by law. The exact timing comes from Article 58 of Resolution 23,759\/2026 of Brazil&#8217;s Superior Electoral Court (TSE), which sets the window from 5 PM on September 29 to 5 PM on October 6. The protection covers every citizen with a voter registration, regardless of where they vote. In practice, arrest warrants that don&#8217;t fall under the exceptions remain suspended until the period ends.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The three exceptions that still allow an arrest<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law does not create total immunity. According to the TSE, a voter can still be arrested in three situations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Caught in the act (flagrante delito)<\/strong>, when the person is caught committing the crime or shortly afterward \u2014 including election-day crimes such as vote-buying or illegal campaigning at polling stations.<\/li>\n<li><strong>A final criminal conviction for a non-bailable offense<\/strong>, such as drug trafficking, racism or heinous crimes.<\/li>\n<li><strong>Violating a safe-conduct order<\/strong>, an authorization issued by the electoral courts to protect someone facing threats to their right to vote.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Outside these situations, election law experts say the following cannot be enforced during the period: pretrial or temporary detention orders, convictions for bailable offenses, or civil imprisonment over unpaid child support.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who else is protected, and since when<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The same article of the Electoral Code sets broader rules for candidates, poll workers and party monitors. Candidates have already been protected since September 19 \u2014 15 days before the election \u2014 and can only be arrested if caught in the act. Poll workers and monitors are protected only while performing their duties on election day. If there is a runoff, set for October 25, the rules apply again: candidates are protected starting October 10, and the restriction on voters resumes on October 20.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why this rule exists<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The safeguard dates back to Brazil&#8217;s 1932 Electoral Code, from an era when local political bosses used arrests to intimidate voters and block opposition votes. The idea was kept in the current 1965 code to prevent the threat of detention from being used as a pressure tactic in the run-up to elections.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What happens if the rule is broken<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If an arrest happens during this period, the Electoral Code requires that the person be brought immediately before a competent judge. If the judge finds the detention illegal, they must release the person and investigate who ordered or carried out the arrest.
